You can claim if you are:

  • A wife, husband or civil partner
  • A child (minor or adult), including adopted or has been treated as a child of the marriage
  • A former wife, husband or civil partner – if have not remarried before the death.
  • Someone who has lived with the deceased for at least two years before their death
  • A person who was financially maintained in some way by the deceased.

⚠️ Don't Delay: If you are claiming under the Inheritance (Provision for Family and Dependents) Act 1975, subject to limited exceptions, you must apply to the court within 6 months from the date that probate was granted.
